The European Commission has designated ChatGPT a Very Large Online Search Engine under the Digital Services Act after the service declared at least 45 million average monthly EU users. The designation gives OpenAI four months, through January 2027, to meet additional obligations covering systemic-risk assessment and mitigation, transparency, and independent audits.

Why this matters: Even where a business is not the platform operator, its AI operating model should make accountability concrete. Maintain an inventory of AI-dependent services, intended users and data, safety and misuse risks, human escalation routes, supplier evidence, change records, and incident communications; then revisit those controls whenever a provider changes material capabilities or terms.
